How I calculate
The Family Code sets child support for a minor as a share of the parents' salary and other income: 1/4 for one child, 1/3 for two children, and 1/2 for three or more children (Art. 75(1)).
The court may reduce or increase these shares based on the parents' financial and family situation and other important circumstances (Art. 75(2)).
When withholding a share of income is impossible or difficult, the court may set a fixed monthly amount. Through a contract, the parents cannot set support below the legal share.
When arrears result from the liable parent's fault, that parent pays a penalty of 0.1% of the arrears for each day late (Art. 106(2)).
Example
The paying parent earns 9,000 lei per month and has two minor children. The legal share is 1/3, or 3,000 lei per month, 1,500 lei for each child. Arrears of 6,000 lei paid 30 days late add a penalty of 180 lei.
