How I calculate

Law No. 213/2023 on the State Fee, in force since 1 January 2024, sets fees for claims with a monetary value by brackets. I calculate the fee using the bracket that contains your amount.

Up to 5,000 lei, you pay 5%, with a minimum of 150 lei as an individual and 250 lei as a legal entity. Between 5,000 and 50,000 lei, you pay 250 lei plus 4% of the amount above 5,000. Between 50,000 and 1,500,000 lei, you pay 2,050 lei plus 3% of the amount above 50,000.

Between 1,500,000 and 5,000,000 lei, you pay 45,550 lei plus 2%. Between 5,000,000 and 10,000,000 lei, you pay 115,550 lei plus 1%. Above 10,000,000 lei, you pay 165,550 lei plus 0.5% of the amount above 10,000,000. The new law has no maximum cap.

You pay 85% for an appeal, 70% for a cassation appeal, and 55% for a revision, based on the fee calculated on the disputed amount. When you file the case, you add a stamp fee of 200 lei.

Example

You claim a debt of 100,000 lei in court as an individual. The state fee is 2,050 + 3% × 50,000 = 3,550 lei. You add the 200 lei stamp fee, so you pay 3,750 lei. If you lose and appeal the entire amount, you pay 85% of 3,550, which is 3,017.50 lei.

Who does not pay the state fee?

Annex No. 2 to Law No. 213/2023 exempts, among others, individuals bringing claims for reinstatement at work and unpaid wages, child support claims, and consumer rights claims. Check the full list before you pay.

Can I ask for an exemption or instalments for the stamp fee?

Yes. After Constitutional Court Decision No. 20 of 26 September 2024, the court decides case by case, based on your financial situation, whether to exempt you, defer the payment, or allow instalments for the stamp fee.

Do I recover the fee if I win?

Usually, the losing party compensates your legal costs, including the state fee. The Constitutional Court also removed the ban on compensating the stamp fee.

How do I pay the state fee?

Pay online through MPay or at a bank, into the account of the court where you file the claim. Attach proof of payment to the claim.
