Child's hand in a parent's hand against a warm background

After a separation, you continue supporting your child through child support. I explain the rules in the Family Code of the Republic of Moldova and show you how to estimate the amount in my child-support calculator.

How much the parent pays

Art. 75(1) of the Family Code sets child support for a minor as a share of the parent's salary and other income:

Number of childrenShare of income
1 child1/4
2 children1/3
3 or more children1/2

Example: the parent earns 9,000 lei per month and has two minor children. Child support equals 1/3 of 9,000, or 3,000 lei per month, with 1,500 lei for each child.

The court can change the share

Art. 75(2) allows the court to reduce or increase the share. The judge considers the parents' financial and family circumstances and other important facts: other dependant children, a parent's illness, or the child's special needs.

A fixed amount when income is irregular

When withholding a share from income proves impossible, difficult, or seriously harms one party's interests, the court can set a fixed monthly amount. The court can also choose a combination: a fixed amount plus a share of income. This option helps you when the parent works without a contract or earns income from several sources.

Agreement or court case

You can sign a child-support agreement. The agreement cannot set child support below the share in Art. 75. If you and the other parent cannot reach an agreement, ask the court to order child support.

A claim for collection of child support receives an exemption from the state fee under Law No. 213/2023 on the State Fee.

Late-payment surcharge

When the parent who owes payment under a court judgment causes the delay, that parent pays a 0.1% surcharge on the overdue amount for each day of delay (Art. 106(2) of the Family Code). When the parent pays a 6,000 lei arrear 30 days late, the delay adds 180 lei.

What to prepare

  • the child's birth certificate;
  • evidence of the other parent's income, if you have it;
  • evidence of the child's expenses: kindergarten, school, treatment, activities;
  • the divorce judgment or existing agreement, if you have one.
